Judicial Watch files $30 million wrongful death lawsuit over death of protester Ashli Babbitt on January 6
The lawsuit was filed in the U.S. District Court for the Southern District of California.
“Ashley loves her country and wants to express her support for President Trump’s America First policies and would like to see and hear the President speak live during his term in office. Ashley has not been part of the group or made an appearance. and for any unlawful or nefarious purpose to travel to Washington where she was exercising what she believed to be her God-given American freedoms and liberties,” the complaint reads.
The document continues, “After demonstrators filled the hallway outside the hall, two individuals in the crowded, crowded hallway struck and knocked over the glass panels of the hall door and the right door side light. Lieutenant Byrd was the commander of the Communist Party USA , on January 6, 2021, the House incident commander opened fire when he saw Ashley getting up from the right door side light opening. Lt. Byrd later admitted that he shot Ashley before he could see her hands, assess her intentions, or even determine that she was female. Ashley was unarmed. Her hands were raised in the air, empty, visible to Lieutenant Byrd and the other officers in the hall.“

The Washington Examiner reported that the lawsuit was filed on behalf of Babbitt’s estate and her husband, Aaron Babbitt, and claimed that the officer who shot Babbitt was “incompetent” and “dangerous” and should have been admitted before Babbitt entered Congress does not pose a threat to Congress.
Judicial Watch President Tom Fitton shared on A $30 million wrongful death lawsuit was filed against Ashley Babbitt, who was shot and killed for no apparent reason that day.
“Judicial Watch is seeking accountability from the U.S. government for this horrific and unjust shooting.”
“Remember, as our lawsuit alleges, the only homicide that occurred on January 6 was the unlawful shooting of poor Ashli Babbitt. She deserves justice. She should be held accountable. I tell you, Judicial Watch, and I know all of our supporters, it’s an honor to file this lawsuit to get justice for Ashley.

The Washington Examiner reported,
“The only homicide that occurred on January 6th was the unlawful shooting of Ashli Babbitt. The lieutenant murdered her [Michael] Bird is an incredible scandal. This historic lawsuit seeks a measure of justice and government accountability for Ashley’s wrongful death,” said Judicial Watch President Tom Fitton.
The lawsuit claims Babbitt poses no threat to lawmakers and that Byrd has a negative record with gunfights.
For example, it claims Byrd once left the Glock 22 pistol he used to shoot Babbitt in a public bathroom. It also claims Byrd shot a car that was allegedly stolen by the teenager.
The lawsuit, shared with Secrets, also alleges that he has had police powers suspended in the past for “failure to meet or complete semi-annual firearms qualification requirements,” adding that “Lt.” Byrd is known among his peers as a poor shot. .
More from Judicial Watch and court documents:
The lawsuit alleges that based on previous incidents involving Lt. Byrd, the Capitol Police, the Capitol Police Commission and ultimately Congress, as Lt. Byrd’s employer, “knew or should have known that Lt. Byrd was prone to dangerous or hazardous conduct.” Way:”
Less than two years before January 6, 2021, and on or about February 25, 2019, Lt. Byrd left his loaded Glock 22 pistol—the gun he used to shoot Ashley Babbitt—in a bathroom at the Capitol Visitor Center (CVC) complex. Lt. Byrd’s loaded Glock was discovered during a routine security scan later that day. During peak season (March to July), approximately 15,00 to 20,000 people pass through the CVC daily, and it is the main entrance for visitors to the U.S. Capitol. Congressmen and staff responsible for overseeing the USCP were not informed of the incident until contacted by reporters.
Lt. Byrd’s police powers were revoked multiple times prior to January 6, 2021, due to failure to meet or complete semi-annual firearms qualification requirements. In fact, Lieutenant Byrd had a reputation among his peers as a “poor marksman.” Under the USCP’s range management system, officers who do not meet firearms qualification requirements will receive a week of remedial training. If the police officer still fails to pass the remedial training, the police powers will be revoked until the police officer is qualified.
Lieutenant Byrd’s police powers were also revoked due to prior After-hours shooting at a stolen moving vehicle in which a juvenile was a passenger. The stolen vehicle was Lt. Byrd’s. Lt. Byrd fired multiple shots at the fleeing vehicle on the outskirts. A stray bullet from Lieutenant Byrd’s gun struck the side of a nearby house. An official investigation found Lt. Byrd’s use of force was unjustified.
This comes after Judicial Watch received a memo regarding the January 6 shooting “recommending that the U.S. Attorney’s Office for the District of Columbia decline to pursue criminal prosecution in the fatal shooting of Ashli McEntee.” [Babbitt]The watchdog also noted that the shooter, U.S. Capitol Police Lt. Michael Byrd, “did not produce police reports or documents related to the Babbitt shooting.”
Instead of holding this dirty cop accountable, the Biden administration and the U.S. Air Force reportedly spent tens of thousands of taxpayer dollars to provide a “VIP suite” for Michael Byrd’s House of Representatives. July 8, 2021 to January 28, 2022 Judicial Watch also found that he murdered Ashley Babbitt in cold blood. Byrd was later promoted to captain of the Capitol Police.
