The professor believes Democrats should simply replace Kamala Harris with Barack Obama as Biden’s 2024 running mate.
He even tried to suggest that even if something happened to Biden and Obama became president, there would be no constitutional issue here.

Biden-Obama is the “Plan C” ticket
“The Biden and Obama votes will have a better chance of defeating Trump,” said legal scholar John Banzhaf, a professor at George Washington University Law School.
“Barack Obama is probably one of the few people most Americans want and trust to be president, so Plan C is probably among the many very unpopular and questionable options Biden and the Democrats have now available to them. One of the most unpopular and offensive,” he said Thursday.
Benzaf cited analysis by constitutional scholars in dismissing concerns that the 12th and 22nd Amendments barred the previous two presidents from serving as vice president.
“The 22nd Amendment is most often cited as preventing Barack Obama from serving another term as president, but based on its carefully crafted and very narrow exclusionary language, it does not do that,” Banzhaf said.
The key sentence in the amendment is: “No person shall be elected President more than twice, and no person who has served as President or Acting President for more than two years shall be elected President for more than two years.”
“While this amendment may prevent Obama from being ‘elected’ to the presidency again, it is clear from its clear language that it does not prohibit him from being elected as vice president and subsequently not being elected,” Banzhaf said. to succeed the President.
