Judge Erin Cannon dismissed the high-profile classified documents case on the grounds that the appointment of special prosecutor Jack Smith was illegal.
The decision is a major blow to the Biden administration and the Justice Department, raising questions about the integrity of the entire investigation.
Attorney General Garland violated the Constitution by appointing Jack Smith to engage in this politically motivated persecution of President Trump.
The decision effectively halts the prosecution, led by special prosecutor Jack Smith, who was appointed by Attorney General Merrick Garland.
The court found that Smith’s appointment did not comply with the Appointments Clause, which requires principal U.S. officials to be appointed by the president and confirmed by the Senate.
The Special Counsel’s use of a permanent indefinite appropriation was also held to be a violation of the Appropriations Clause, although the court did not consider a remedy for this funding violation because it dismissed the appropriation on Appointment Clause grounds.
This case was never a matter of equal application of the law. The Justice Department was so eager to catch Donald Trump that Attorney General Garland violated the Constitution in the process.
