I learned a few things about Alitos last week. They seem to have a flagpole at home and use flags to convey messages. I’m not sure if Alitos took a flag semaphore course. I don’t know what these messages are.
At her home in Alito, Virginia, Mrs. Alito hung the flag upside down during a dispute between neighbors. Is this some secret symbol Martha Ann is using to try to stop the theft? There is no actual evidence for this, but countless news reports and politicians have taken the implication to be obvious. I think it’s more likely she was trying to send a signal of distress to her neighbors.
Last summer, a “Call for Safe Haven” flag flew at Alito’s home in New Jersey. I had never heard of this pine flag before. The origins of this flag can be traced to George Washington’s Continental Army in 1775.

I think it’s more likely that the Alito family used the flag to convey some sort of religious message. What exactly, I’m not sure. But let’s assume Justice Alito personally chose to fly the flag. At least here, he doesn’t blame his wife, so we can infer that he knew about the flag. Most of the New York Times The article focused on whether Alito should recuse himself from any Trump-related cases. But to my surprise, they missed a more obvious angle: If Alito was trying to espouse some kind of Christian nationalism, shouldn’t he recuse himself from all Free Exercise and Establishment Clause cases? Why limit recusal attacks to election cases?
There is plenty of other evidence available if you want to go this route. Justice Alito has publicly attended Mass in churches across the country and given speeches lamenting how religious freedom is under siege. Forget about the mysterious symbols of the arboreal flag. Alito has been quite public about his views on the topic.
I know it’s a little crude to talk about Justice Ginsburg, but I will. In August 2013, she made headlines when she became the first Supreme Court justice to officiate at a same-sex wedding. Five months later, the Supreme Court approved Obergefell v. HodgesIn June 2014, Justice Ginsburg joined the majority opinion that held that the right to same-sex marriage fell into the shadow of the Fourteenth Amendment. The act of marrying a same-sex couple was more than just a mystical flag that signaled Justice Ginsburg’s views on the subject. She didn’t shy away. Ginsburg did apologize for her remarks about President Trump, but he did not recuse herself from Trump-related cases involving his conduct during the election.
