Joe Biden called for major reforms to the U.S. Supreme Court in a speech today.
Many are wondering why Biden is trying to do this. He is the lamest lame duck president in decades, with no political capital to trade. This is likely an effort by Democrats to squeeze one last major policy initiative out of Biden’s now-failed presidency.
Legal experts have weighed in and said Biden’s proposal won’t go anywhere.
The Washington Examiner reports:
Legal experts say Biden’s Supreme Court overhaul already on life support
Legal experts from across the aisle say President Joe Biden’s ambitious three-pronged Supreme Court reform proposal is unlikely to survive its 15 minutes of fame.
Harmeet K. Dhillon, a California Republican National Committeewoman and attorney, told The Washington Post, “This is all about posturing for the election season, trying to win votes among the far left, but also To intimidate the U.S. Supreme Court into not taking the current path of enforcing the Constitution.
Steve Vladeck, a professor at Georgetown University Law Center, questioned in a July 18 Substack blog why Biden is only highlighting the recent Trump v. United States decision when Democrats have many more Other High Court decisions.
“Is it possible to overturn Rucho with an amendment and reaffirm that federal courts can rule serious partisan gerrymandering? Or is it possible to overturn Citizens United with an amendment and allow Congress to meaningfully limit funding in our elections? Or is it overturned Dobbs’ amendment? All have exactly the same chance of approval by two-thirds of the House and Senate (0.0%),” Vladek wrote…
Additionally, Vladek expressed caution about an enforceable ethics code for the nine justices, saying that if anyone other than the justices had the power to enforce the code against members who violate their duties, “we would no longer have ‘a “Supreme Court.” As Article III, Section 1 says, we must; we will have two.
A majority of Americans don’t even think Joe Biden should remain president. No one, let alone the nation’s highest court, would listen to his comprehensive advice on any subject.
