More than 10 million home sellers have received or will receive a slew of notices that they may be entitled to payments from proposed commission settlements by a handful of real estate brokerage firms.
JND Legal Administration, the firm retained by attorneys to oversee administrative tasks related to the Gibson Commission proceedings, has Since March, JND has sent more than 10 million postcard notices to potential class members and more than 27 million email notices, according to other legal documents JND provided to Inman.

Not all brokerage firms listed in Gibson’s lawsuit have reached settlement agreements, and the total settlement pool could grow in the coming weeks. EXp Realty is the largest company that has yet to reach a settlement.
Home sellers may qualify if they list their home in the following areas and time frames:
- In Alabama, Georgia, Indiana, Maine, Michigan, Minnesota, New Jersey, Pennsylvania, Tennessee, and Vermont between October 31, 2017, and July 23, 2024 , Wisconsin or Wyoming to participate in the MLS
- Playing MLS in Nevada from January 15, 2018 to July 23, 2024
- Playing MLS in Arkansas, Kentucky or Missouri between October 31, 2018 and July 23, 2024
- Playing MLS in California between October 2, 2019 and October 2, 2019 July 23, 2024
- On the MLS anywhere in the United States (except the states listed above) between October 31, 2019 and July 23, 2024.
The brokerage firms have agreed to pay a total of more than $110 million. If settlements from the National Association of Realtors, American HomeServices, Keller Williams and others are included, the total amount exceeds $730 million.
The plaintiff’s attorney is entitled to receive up to 33.3% of the award, plus out-of-pocket expenses incurred during the case.
