Senator Durban said in a statement, “Let us be clear: Chief Justice Roberts has the power to impose an enforceable code of conduct. He has refused. Until he takes action, I will continue to push for legislation.”
Senate can’t do anything about Clarence Thomas
The problem is, without new legislation, there’s not much the Senate can do. Impeachment proceedings against Thomas must begin in the House of Representatives. The chances of House Republicans investigating Clarence Thomas are less than zero. The Republican House majority also won’t pass any legislation that would lead to ethics reform or Supreme Court oversight.
Democrats have introduced a bill that would require the Supreme Court to establish ethics rules and independent oversight, but the bill would not become law until January 2025 at the earliest if Democrats control the entire federal government.
In the meantime, all Senator Durbin can do is push legislation and continue investigations.
But if Democrats take back the House and keep the Senate and House, Clarence Thomas’ days as a corrupt Supreme Court justice may be numbered.
