Republican Rep. Anna Paulina Luna said last week she would bring an inherent contempt vote in the House after the Justice Department declined to prosecute U.S. Attorney General Merrick Garland.
“Under an inherent contempt proceeding, the House or Senate has its sergeant-at-arms or deputy detain a person for proceedings before Congress,” the National Constitution Center said.
Justice Department won’t prosecute Merrick Garland for holding Biden tape in contempt of Congress.
“The department has determined that Attorney General Garland’s response to the committee’s subpoena did not constitute a criminal offense and therefore the department will not pursue a congressional contempt of court charge,” the department said in a letter to House Speaker Mike Johnson on Friday. Subpoena or take any other action to prosecute the Attorney General before a grand jury.
“The Department of Justice is not above the law. Garland is not above the law. The inherent contempt will be evoked and brought to the floor,” said Ana Paulina Luna.
“I have filed the resolution and I will call a vote,” Rep. Anna Paulina Luna said Friday afternoon.
Fox News senior congressional correspondent Chad Pegram wrote: “Fox has been told that Democrats may take action or rescind the resolution that holds Garland in “inherent contempt.” This vote is therefore one step away from an actual up/down vote for an act of inherent contempt. If the House moves to the negotiating table, the problem is solved. However, if the House refuses to introduce the measure, it will proceed with a vote on the actual inherent contempt. Fox has learned that Garland has reached out to moderate Republicans to pressure them to reject their inherent disdain.
2) The last time Congress used its inherent contempt power was in 1934, when it detained a Commerce Department official for ten days in Washington’s Willard Hotel for refusing to cooperate.

Rep. Anna Paulina Luna launched a scathing attack on Attorney General Merrick Garland in a series of explosive posts.
There are reports that Garland is personally reaching out to moderate Republicans to urge them to vote against the “inherent contempt” for him.
Rep. Luna wrote:
Garland is reportedly calling moderate Republicans to ask them to vote against the inherent contempt for him. Garland, you can hand over the tapes and make this go away. You willfully ignored a congressional subpoena…
Garland is now calling on congressional Republicans to pressure them not to vote for the inherent contempt. This is the definition of corruption. He believed he was above the law and could tell members of Congress what to do.
Why did Garland work so hard to hide the tapes? What on the tape led him to commit criminal acts to protect Biden? Any other American would be in jail for what he did.
Garland, give the tape to Congress so we can listen to it.
Garland, why don’t you call me too? You should know my cell phone number. I’d like to hear your perspective on why you think you shouldn’t be held responsible?
