While you may now know that one of the results of the Commission litigation settlement was an end to the publication of cooperative indemnities on NAR-affiliated MLSs, you may not realize that there is still much debate over whether, where, and how indemnification is provided.
In May, Justice Department attorney Jessica Leal said: “We believe that claims for compensation should not be brought anywhere, especially in the MLS.” More recently, Jason Abrams, director of industry and learning at Keller Williams, said : “Sellers can still decide to offer co-op compensation exclusively and can market anywhere other than the MLS. This may include newsletters, newsletters, carriers, etc. or the broker or agent’s own website.
